What is copyright?
Copyright, according to the English language is a term follow English – America law system used to show the non-physical to the intellectual work. Copyright is one of three areas of intellectual property: copyright and related rights, industrial property rights and rights to plant seeds) in Vietnam in particular and the country on the legal system European continent.
According explained in Article 4 Intellectual Property Law in 2005 by the National Assembly of Socialist Republic Vietnam
“Copyrights are the rights of organizations and individuals who do their work or creative property.”

Copyrights are used to protect the creative products in the field of literature, art and science can by any means or any form. This right includes the moral rights and property rights (economic benefits) in the author’s relationship with their work.
Why register copyright?
Copyright arising from the time that work is creative and be under a form of material, regardless of content, quality, form, media, language, has published or not, registered or not registered.
However, the set of a basis in cases where a dispute occurs again depends very much on the legal basis and it is important to demonstrate the responsibility of the person requesting agencies jurisdiction.
looking at a real example:
In dispute of copyrighted song “Tinh thoi xot xa” between the Musicians Bao Chan and female Musicians Keiko Matsui (Japan), Bao Chan can be the author in fact, but no one can believe him if he does not have a certificate of copyright as Keiko. In this case, Keiko is sure to be the winner. Copyright certification became best evidence in Court.
That is why the authors are encouraged to implement procedures for registering copyright for their work when completed creative work. With a works has been registered copyright, the author is sure of:
- Because their assets are protected.
- As the higher legal value than the same works.
- People into the same principles and standards of the world.
- The duration of protection extended to 50 years after author death (now it will be 75 years)
- Scope of protection are 163 countries worldwide
