1. What is a work permit?

2. What is a work permit extension?

Extension of Work Permit is an administrative procedure that the Company carries out to extend the term of the permit, whereby Foreigners are allowed to continue working after the work permit has expired.

An extended work permit can only be made if the Foreigner continues to work at the Company with the same position and job title.

In case a foreigner changes company or a foreigner still works at the old company, but changes his title or position, a new work permit must be applied.

3. When should I renew my work permit?

The work permit can only be extended if it is valid for at least 5 days but not more than 45 days.

Before submitting the application for extension of the Work permit, the company must apply for a written approval of the need to employ foreign workers and the Foreigner needs to have a medical examination (see detailed instructions in Section 5 below).

Lawyers advise companies to do procedures to renew Work permit before the Work permit expires in the period from 30 days to 45 days.

4. Conditions for extension of work permit in Dong Nai

To be extended a work permit in Dong Nai, the Company and the Foreigner must meet the following 3 conditions:

  1. The issued work permit is still valid for at least 05 days but not more than 45 days.

Note: When the Work Permit expires, the procedure for extending the Work Permit cannot be carried out.

  1. The company is approved by the competent authority to use foreign workers.
  2. Foreigners continue to work for the Company according to the contents of the issued Work Permit.

5. How to extend a work permit in Dong Nai

To renew your Work Permit, you must do the following 3 steps:

Step 1: The company reports on the change in demand for foreign workers

– Certificate of business registration.

♦ Submit at: Department of Labor, War Invalids and Social Affairs of Dong Nai, address: No. 5, Phan Dinh Phung Street, Quang Vinh Ward, City. Bien Hoa, Dong Nai Province.

♦ Duration: at least 30 days before the expiry date of the current Work Permit.

♦ Processing time: 10 days from the date of submission of complete and valid dossiers.

Step 2: Health check

Foreigners can have a medical examination at a foreign medical facility or a Vietnamese medical facility if the Foreigner is residing in Vietnam.

Step 3: Apply for a work permit extension

– Written request for extension of work permit (Download);

– Current work permit;

– Health certificate/health examination certificate valid for 12 months;

– Documents proving that the foreigner continues to work for the Company in accordance with the contents of the issued Work Permit;

– 02 color photos, photos not older than 06 months;

– A written approval of the need to employ foreign workers (as a result of step 1);

– Passport;

– Certificate of business registration;
