– Decree 16/2020/ND-CP dated February 3, 2020 detailing a number of articles and measures to implement the Law on Vietnamese Nationality;

– Circular No. 55/2021/TT-BCA dated May 15, 2021 of the Ministry of Public Security guiding the implementation of the Residence Law 2021.

4. Conditions for dual citizenship for overseas Vietnamese

In order to registered for dual citizenship, Viet Kieu need to meet the following 02 conditions:

First: Having papers proving that they used to have Vietnamese nationality or still hold Vietnamese nationality according to the provisions of Vietnamese law.

Second: Having a legal residence in Vietnam, including a house owned by oneself or a house rented, borrowed or stayed at another person’s house or sponsored by a relative.

5. Instructions on how to do dual citizenship

To apply for dual citizenship, you need to follow these 4 steps:

Step 1: Prepare a set of documents for registration of dual citizenship in Vietnam according to Section 6 below.

Step 2: Submit the application file at the Immigration Department of the Police Department of the province/city directly under the central government.

Step 3: Receive the results of settlement of consent for Viet Kieu to return to Vietnam to permanently reside at the agency where you have submitted the application for dual citizenship.

Step 4: Carry out the following procedures after obtaining the consent for Viet Kieu for permanent residence registration such as: entering the local household registration, applying for a Vietnamese citizen identity card and passport.

6. What does the application for dual citizenship include?

To apply for dual citizenship, you need to prepare a set of documents including the following documents:

1) An application for permanent residence in Vietnam.

2) Copy of foreign passport or permanent residence document issued by foreign country.

3) A copy of one of the following papers valid for proving Vietnamese nationality, such as:

  • Birth certificate (in case the birth certificate does not clearly show the Vietnamese nationality, it must be accompanied by papers proving the Vietnamese nationality of the father or mother);
  • Nation ID;
  • Vietnam passport;
  • Decision on returning Vietnamese nationality, Decision on recognition of adoption for children being foreigners, Decision on allowing foreigners to adopt Vietnamese children;
  • Other papers (certificate of citizenship) issued by a competent Vietnamese agency certifying that the involved party still retains Vietnamese nationality in accordance with Vietnamese law on nationality.

4) Copy of documents proving lawful residence in Vietnam:

  • In case overseas Vietnamese have been allowed to own a house in Vietnam, provide a certificate of house ownership or documents on buying, selling, gifting, giving, exchanging, inheriting houses, house purchase contracts,…
  • In case overseas Vietnamese rent, borrow or stay at another person’s house or are guaranteed by a relative, a contract for renting, lending or letting them stay at home; A document proving that the lessor, loaner or requester agrees to allow such person to register for permanent residence; Papers and documents evidencing the ownership of the house of the lessor, borrower, or stayer.

7. State agencies apply for dual citizenship.

8. Processing time for application for dual citizenship.
